Data protection statement of Pharmagenies and VIPharma

1. Who are we?

The data controller in accordance with this Data Protection Statement is the company ("we") listed below.

– For the data processing required within the VIPharma loyalty programme: B&K Associates GmbH, Burgfelderstr. 4, 4055 Basel.

2. What personal data do we process and for what purposes?

We collect personal data directly from you, e.g. when you provide us with personal data as part of a purchase or an order for goods, when you use your Starcard and when you communicate with us. Personal data may also be collected from other sources; this includes in particular information about your creditworthiness and other similar information provided by credit companies, data from mailing list brokers, data from financial service providers when you make payments and information about you provided by third parties, e.g. as part of administrative or judicial proceedings or in the course of communicating with us.

We process your personal data primarily in connection with the purchase of goods in pharmacies or on the Internet via our online shop (amavita.ch), for the issuance and administration of our loyalty card "Starcard", as well as for the specific purposes described below and for other purposes which we notify you of separately or which are self-evident:

– for the execution of purchase contracts, including the management of shipping and payment, invoicing to insurers, credit management and the handling of returns, claims and warranty cases. More information on this can be found in our general conditions;

– for verification of solvency when selecting the payment method (purchase against invoice);

– for the implementation of loyalty programmes such as Vipharma (point 4);

– for communication with you and third parties, as well as for customer support;

– to analyse the ordering and purchasing habits of our customers with a view to improving our assortment and the presentation of our articles, e.g. by breaking them down into specific customer segments;

 

– for advertising and marketing, e.g. for customer events, for sending specific information to target groups and for marketing communications by post, e-mail, SMS and push notifications via web or app;

– for the planning, administration and customisation of our website;

– for the verification and fulfilment of legal obligations, for the identification, detection and prevention of abuse and for the assertion of rights or the rejection of claims;

– for internal purposes, e.g. for the preparation and execution of acquisitions and disposals of companies and other related transactions, for the administration and management of our IT and other resources, for accounting, archiving, training and other administrative purposes, for the control and improvement of our internal processes and for the protection of the safety of our employees and our premises.

 

3. To whom do we pass on your personal data?

We generally consider your personal data to be confidential information and respect the principle of proportionality for any transmission of data. Our employees have access to your personal data to the extent necessary for the purposes described and for the performance of their duties.

The data controller companies referred to in point 1 may exchange personal data in connection with purchases or Vipharma, in particular when you use Vipharma during purchases or cash Vipharma vouchers. For example, B&K Associates receives information about Vipharma (e.g. that you are a participant in the Vipharma loyalty programme), or receives information about your purchases. We may also disclose your personal data to other companies in the Group and to third parties, insofar as we use their services (e.g. external service providers we use to send newsletters by e-mail, forwarding agents to send the goods or printers to print hard copy material for mailings).

In some cases, your personal data may also be passed on to third parties, such as insurers for the billing of your order or authorities and courts as part of a proceeding or request for disclosure. We may also share your personal data (such as your name and address or your membership of a certain customer segment) with other companies for advertising purposes, excluding health-related and other particularly sensitive personal data. You can object to this transmission at any time by sending us a notice (point 1).

If we disclose your personal data abroad (e.g. to the aforementioned supplier Emarsys), we ensure that the recipient guarantees that an adequate level of data protection is observed, in particular through appropriate contracts.

4. How do we process the personal data required for the VIPharma programme?

If you join the "VIPharma" loyalty programme ("programme"), we process your personal data in order to prepare and carry out the programme. In particular, we process your name and contact details, as well as information on the purchases you have made using your VIPharma account, the credits you have received in this context ("points"), the current balance in your account and the use of points or VIPharma cheques. We are entitled to use this personal data also for the purpose of detecting and combating possible misuse. In addition, we use your purchase data to analyse your ordering and purchasing habits in order to improve our product range and presentation and to send you targeted advertising, unless you object to this.

5. How do we process personal data in connection with the websites?

When you visit our website and make a purchase in our online shop, we process certain technical data (e.g. information about the time of access to the site, the duration of the visit, the pages consulted and the terminal device used) both to be able to provide the website and to ensure IT security and improve your experience as a user. We also use "cookies", i.e. files that are saved on your terminal when you visit our website, and related technologies such as "pixel tags" or "web beacons". Some cookies are essential for the functionality of the website (e.g. the shopping cart in the online shop) and are deleted automatically at the end of your visit. Other cookies are used to save settings in the event of a subsequent visit, to compile anonymous statistics on the use of our website and to personalise the content of our internet pages.

We also use third party cookies to enable them to collect the data necessary for their services. This enables these providers to collect information about your use of our website in order to provide their services; this is mainly statistical analysis of the use of our website. However, it is possible that third parties may cross-reference the information collected about you with data from other websites that you visit and use it for their own purposes (e.g. to influence the partner sites of these providers). If you are registered with the third party provider in question, they will be able to identify you.

In these cases, the processing of your personal data takes place under the responsibility of the provider, in accordance with his data protection provisions.

An example of a statistical analysis service is Google Analytics, a Google service based in the USA. Google uses cookies to collect information about your behaviour on our website and the terminal device you use (tablet, PC, smartphone, etc.), e.g. information about your browser, the website from which you accessed our website, the name of your provider, your IP address, the date and time you access the website, the pages you visit and the duration of your visit, as well as any visits to other websites and applications. Google provides us with analyses on the basis of this information. It stores this data in the USA, but shortens your IP address within the EU or the EEA. You can prevent the use of Google Analytics by using a browser add-on available at https://tools.google.com/dlpage/gaoptout?hl=it.

Another example of a statistical analysis service is Hotjar's technology. Hotjar uses cookies and other technologies to collect data about the behaviour of our users and their devices (e.g. screen size, device type, browser information, country). The IP address of your device is only collected anonymously during your use of the website. Hotjar stores this information on our behalf in a pseudonymised user profile.

You can prevent the use of the technologies mentioned above and set your browser not to accept cookies and delete saved cookies. You can also use your e-mail programme settings to prevent the transmission of data on your e-mail usage.

If our content is presented on the website of a third party provider, they will collect and process personal data if you use their platform. For example, we are present with certain pages on Facebook ("fanpages") and, if you access these pages, Facebook, as the controller, collects usage data in accordance with its own data protection policy.

6. How do we process personal data in connection with newsletters?

By providing us with your e-mail address when ordering goods, registering for a newsletter or taking part in one of our competitions, you authorise us to use this address for the digital transmission of newsletters and advertising relating to our offers and the offers of other pharmacies belonging to the Group.

Our newsletters are sent by email via the technical service provider MailChimp, to which we pass on the data you have provided when registering for the newsletter. The data you enter in order to receive the newsletter (e.g. your e-mail address) is stored on MailChimp's servers in the EU. Emarsys uses this information to send and statistically evaluate the newsletter on our behalf. This data on your clicking and surfing behaviour is collected pseudonymously and only linked to your personal data if you do not object (setting "Do not track me"). The data is used exclusively for the statistical analysis of the newsletter campaigns in order to improve the content.

7. How long do we keep your personal data

We keep your personal data in identifiable form for as long as it is necessary to fulfil the specific purposes for which we collected it. If it has been collected for contractual purposes, we generally keep it for at least the duration of the contractual relationship. We also retain personal data if we have a legitimate interest in doing so, e.g. for the purposes of documenting and preserving evidence and for the protection and defence of legal claims. In addition, we retain your personal data for as long as they are subject to a legal retention obligation.

8. How do we protect your personal data?

We take appropriate technical (e.g. encryption, pseudonymisation, notification, access restriction, back-up, etc.) and organisational (e.g. instructions to our employees, confidentiality agreements, controls, etc.) security measures to safeguard your personal data against unlawful or unauthorised processing or against the risk of loss, accidental alteration, unintentional disclosure or unauthorised access.

9. What are your rights with regard to the processing of your personal data?

You may object at any time to the processing of your data, in particular to processing for the purpose of direct marketing (e.g. refusal of e-mails containing advertising). You also have the right to request information, to have your personal data corrected and to object to further processing. You also have the right to withdraw your consent.
